Duties Description The Director of Intake is an experienced attorney who is responsible for effective and efficient intake management of all complaints submitted regarding allegations of prosecutorial misconduct in New York State. The Director of Intake will report to the Administrator. Duties of Director of Intake will include, but will not be limited to: • Manage day-to-day operations of a high volume, highly detailed intake process and initial evaluation and assessment of allegations of prosecutorial misconduct submitted to the Commission on Prosecutorial Conduct (CPC) to ensure efficiency and effectiveness, while maintaining quality and consistency of review;, • Develop and implement policies and procedures that guide the intake process; review, analyze, and make recommendations to the Administrator on the intake process performance to identify and take action on areas for improvement; devise and develop new strategies and set annual goals to improve the efficiency of evaluation to process cases more quickly while maintaining the integrity of the review;, • Establish and operationalize quality review systems to ensure cases are being evaluated in a timely and high-quality manner;, • Organize, maintain and oversee management of a case management system for the intake of submitted complaints;, • Manage and supervise the Intake Unit, a team of attorneys and administrative assistants, evaluating and reviewing pending and incoming complaints to keep them aligned, focused, motivated and high-performing;, • Recruit, train and supervise Intake Unit staff, providing leadership and direction to enhance communication and project management of an intake process;, • Engage in preliminary analysis of complaints submitted to the CPC and draft memoranda for the Commission to aid in its determination of whether to open an investigation;, • Work collaboratively with CPC attorneys, including the Administrator and Deputy Directors of Investigations, to analyze and report on complaints to determine initial action;, • Conduct, in conjunction with other staff, comprehensive training sessions for both new and existing staff on pertinent legal matters and investigative techniques; and, • Other special projects as needed to enable the CPC to carry out its statutory mandate. Duties and Responsibilities: • Represent immigrants with final orders of removal in appeals, motions to reopen and other proceedings before the immigration courts, Board of Immigration Appeals, and Circuit Courts of Appeal., • Appear in both the detained and non-detained Immigration Courts on a regular basis to represent immigrants in removal proceedings., • Prepare and file appeals to the Board of Immigration Appeals and Second Circuit Court of Appeals as needed., • Collaborate with other attorneys in drafting and filing habeas corpus petitions and other federal litigation as needed., • Prepare and file motions, briefs, forms, affidavits, other supporting documents, motions, and legal memoranda for submission to USCIS and the Immigration Court., • Provide pro se assistance with motions to reopen, applications for asylum, and other related matters., • Screen clients for eligibility for immigration relief, motions to reopen, and grounds for appeals, and develop a strategy for representation., • Interview clients in and out of detention, as well as their witnesses., • Conduct client consultations of detained and non-detained clients and track client cases, progress of applications, and follow up for funding purposes., • Represent NYLAG to our funders and collaborative partners including sharing materials, and attending meetings, conferences, and trainings., • Supervise interns, volunteers, and pro bono attorneys as needed; and, • Juris Doctorate from an accredited school, • Admission to the New York State bar, • Fluency in Spanish required, • Minimum 2 years experience working in removal defense required, 4 years preferred, • Experience working with detained and/or post-order clients preferred, • Excellent writing, speaking and organizational skills, • Ability to communicate effectively with clients, community organizations, attorneys, the judiciary, and the public, • Ability to work in a collaborative setting with other professionals, • Demonstrated commitment to immigrant rights, criminal justice, and/or social justice issues, • Experience working with survivors of trauma and at the intersection of criminal law and immigration law Employment type: ☒ Full-time Professional Level: ☒ Entry Level Salary Range: NYLAG is a unionized workplace, and salaries are set pursuant to a collective bargaining agreement. Job description The New York Legal Assistance Group (NYLAG) seeks a highly motivated, experienced Immigration Attorney for a full-time position with the LGBTQ Law Unit. The LGBTQ Law Unit seeks an experienced fulltime attorney to join our team and advocate for our immigrant clients facing removal. NYLAG’s LGBTQ Law Unit, founded in 2008, exists to protect and expand the rights of the Lesbian, Gay, Bisexual, Transgender and Queer (LGBTQ) community and to provide services that meet the unique legal needs of low-income LGBTQ New Yorkers. LGBTQ communities, especially those of color, transgender and gender non-conforming individuals and youth, are at greater risk of living in poverty and of being targeted for violence. The LGBTQ Law Unit provides free representation and advice on a wide array of civil legal matters, including legal name and gender marker changes, immigration (including removal defense), family law matters (orders of protection, custody and visitation, divorce, and adoption), housing, employment and public accommodation discrimination, wills and advance directives and access to gender affirming healthcare. We engage with community partners to provide legal services and education outreach in community settings throughout the five boroughs and push forward systemic advocacy efforts to advance LGBTQ rights and protections. The Immigration Attorney will represent LGBTQ+ immigrants on detained and non-detained removal defense and post-order work providing full representation and limited scope assistance. The job requires substantive knowledge and experience with removal defense for asylum-seeking LGBTQ+ immigrants including bond hearings, motions to reopen and motions to stay removal before EOIR and BIA, federal petitions for review, individual merits hearings, BIA appeals, habeas petitions and motions for emergent relief from detention or removal. Candidates will have a proactive ability to solve problems under time pressure, a strong commitment to providing client-centered services for clients experiencing trauma, and an ability to work collaboratively with a team of attorneys, paralegals, and volunteers working on a broad range of legal matters impacting the LGBTQ+ community.
