Job Description Purpose of Role: We are seeking a Healthcare Litigation Associate Attorney with 4+ years of Healthcare, Commercial Litigation, and White-Collar Defense experience, including experience as a medical board litigation attorney, preferably a former NJ Deputy Attorney General who prosecuted on behalf of professional boards, including the Board of Medical Examiners. A clerkship with the Supreme Court or Appellate Court is a plus. This role will join our established Health Care practice group representing medical professionals in professional liability/medical malpractice and employment lawsuits. This is an exciting position that offers a competitive compensation package, located in our Roseland, NJ office. Responsibilities: • Handle healthcare litigation proceedings., • Draft pleadings, conduct discovery and responses, motions, briefs, etc., and represent clients in court and arbitration., • Provide legal advice to clients regarding their rights and obligations under relevant laws and regulations., • Develop and execute legal strategies., • Keep up to date with changes in relevant laws and regulations., • Take a lead role in certain healthcare matters., • Provide thorough factual and legal research and analysis., • Review regulatory analyses by junior attorneys., • Manage matters from commencement to final resolution., • Backup support other business units, such as Employment Law and Banking and Financial Services., • Identify legal and compliance issues and business risks and offer effective solutions tailored to the situations., • Identify and escalate to Department Chair as appropriate., • Demonstrate and apply knowledge of general commercial and healthcare law (such as HIPAA, Anti-Kickback, False Claims Act, state regulations, etc.), Medicare and Medicaid reimbursement and compliance issues; or managed care and health insurance regulatory matters, plus pharmacy-related experience., • Juris Doctorate degree from an accredited law school., • NJ bar required; NY admission preferred and otherwise must be obtained., • 4+ years' legal experience with demonstrated excellent working knowledge and primary focus in healthcare., • Prior experience working as a healthcare-centric prosecutor (former Deputy Attorney General or Assistant U.S. Attorney) a plus., • Strong preference for candidates with hospital, health system, 340B, or pharmacy experience., • Experience in advising clients on telemedicine, Medicare/Medicaid fraud, health reform issues., • Knowledge of confidentiality, informed consent, various bioethical issues., • Highly motivated with drive and ability to dig into the details, provide insight and drive decision-making., • Unquestionable integrity, ethics, and judgment., • Ability to communicate legal concepts and opinions in a digestible manner., • Exceptional communication, relationship building, mentorship, and influencing skills with proven abilities across a broad range of internal and external constituents., • Team player with a high level of self and cross-cultural awareness., • Highly intelligent and possesses intellectual curiosity to probe and understand complex business and legal issues and trends., • Adaptable nature, with the ability to reassess and adjust due to the evolving nature of the business.
