We are seeking an experienced Medicaid and Guardianship Associate Attorney with a strong understanding of the Medicaid laws and regulations, Medicaid eligibility, the Medicaid application process, fair hearings, and Article 81 Guardianships. Position Summary: The Medicaid and Guardianship Attorney must have a minimum of 3 years’ experience analyzing difficult Medicaid eligibility scenarios, crafting creative solutions, handling undue hardship waivers, PRUCOL applications, Medicaid applications and Fair Hearings. In addition, the attorney must have 3 years’ experience handling Article 81 Guardianship proceedings from drafting Petitions to preparation of the Order and Judgment, including witness preparation and handling hearings in all counties in the metro-NY area. Attorneys “own” their positions and are 100% responsible for their own work and caseloads. You will have autonomy and independence while being part of a collaborative team. Key Responsibilities: • Prepare Medicaid institutional applications from start to finish along with supporting documentation., • Prepare guardianship petitions, interview social workers, prepare witnesses for hearings, attend guardianship hearings, and handle contested guardianship matters., • Analyze financial records for verification of income, identification of additional accounts, analysis of gifting or theft., • Track and maintain case files, ensuring all documents are organized, up-to-date, and compliant with firm and regulatory requirements., • Maintain contact with dedicated Medicaid & Guardianship paralegal staff to successfully meet strict monthly deadlines., • Collaborate with the Nursing Home and Medicaid Partners to develop and effectuate strategies., • Multitask and handle a high volume of cases and workload., • Handle confidential client information with the highest level of professionalism and integrity. Qualifications: • Juris Doctor (J.D.) degree from an accredited law school., • Active license to practice law in New York., • Minimum of 3 years of experience preparing Medicaid applications and handling guardianship proceedings., • In-depth knowledge of Medicaid laws, regulations, and procedures, especially as they pertain to eligibility, application submission, and post submission issues., • Proven experience managing complex cases with strong attention to detail and organizational skills., • Excellent communication skills, both written and verbal, with the ability to explain complex legal concepts to clients and non-legal professionals., • Strong research, analytical, and problem-solving abilities., • Ability to work independently while also collaborating effectively in a team environment., • Spanish-speaking or bilingual skills a plus.
