Summary: Under the direction of the Chief Operating Officer (COO), the HR Manager serves as the senior human resources leader for NeuSpark PDS, providing both strategic and operational leadership. The HR Manager has overall responsibility for all human resources functions for an organization of approximately 350 employees, including talent acquisition, employee and labor relations, benefits administration, compliance, risk management, and policy development. The HR Manager serves as a trusted advisor to executive leadership, ensuring HR strategies align with the organization’s mission, person-centered values, and operational goals while maintaining compliance with all applicable employment laws, OPWDD regulations, and Medicaid requirements. The role leads the HR Department and directly supervises the HR Recruiter. Essential Functions and Key Responsibilities: • HR Leadership & Department Oversight, • Provides leadership, direction, and accountability for all HR functions., • Develops, implements, and continuously evaluates HR policies, procedures, and practices to ensure legal compliance, operational effectiveness, and alignment with organizational values., • Advises the COO and Executive Director on human resources strategy, workforce trends, risk exposure, and regulatory changes., • Conducts and documents monthly supervision, performance feedback, and professional development planning for the HR Recruiter., • Recruitment & Workforce Planning, • Oversee agency-wide recruitment efforts, including approval of requisitions, job postings, and job descriptions., • Ensures all required pre-employment and ongoing clearances are completed and maintained in compliance with OPWDD and regulatory requirements, including SEL, CBC, SCR, MHL, and DMV checks., • Collaborates with leadership to support workforce planning, staffing levels, and timely hiring to meet programmatic and budgetary needs., • In partnership with the COO, monitor program staffing and salaries to ensure alignment with approved budgets and funding requirements., • Employee Relations & Labor Compliance, • Leads and manages all employee relations matters, including investigations, grievances, disciplinary actions, suspensions, and terminations., • Facilitate fair, timely, and legally compliant resolution of workplace issues, ensuring consistency and adherence to agency policy., • Serve as liaison with labor counsel on employee relations matters, disciplinary actions, and legal risk mitigation., • Represent or coordinate representation for the agency at unemployment hearings, EEO proceedings, Human Rights matters, and other employment-related legal actions., • Ensure executive leadership is promptly informed of significant HR issues, legal claims, or regulatory concerns., • Benefits & Compensation Administration, • Oversee administration of all employee benefit programs, including health, dental, retirement (403(b)), and disability plans., • Review and approve monthly benefit invoices to ensure accuracy, eligibility compliance, and fiscal stewardship., • Provide guidance to employees and managers regarding benefit plans, enrollment, and eligibility., • Coordinate benefits-related events and processes, including open enrollment and HRA administration., • Regulatory Compliance & Risk Management, • Ensure compliance with all applicable federal, state, and local employment laws, • Oversee OPWDD and Medicaid related HR compliance, including monitoring staff eligibility that impacts service delivery and billing., • Conduct and document monthly reviews of the Medicaid Exclusion List (OMIG) to ensure no excluded individuals are employed., • Ensure personnel records are maintained in accordance with legal and regulatory requirements., • Oversee timely reporting of accidents/incidents and ensure Workers’ Compensation claims are filed and managed appropriately., • Training, Communication & Organizational Support, • Develop and deliver HR-related trainings and in-services for managers, supervisors, and staff as needed., • Stay current on changes in labor law, benefits, and HR best practices through participation in trainings, workshops, and provider forums., • Disseminate relevant regulatory and policy updates to leadership and staff in a clear and timely manner., • Reporting, Audits & External Requests, • Prepare and provide monthly HR reports to the COO and Executive Director, including staffing status, open positions, separations, workers’ compensation claims, disability claims, and litigation status., • Respond to audit requests and provide HR-related documentation to auditors, funders, and regulatory agencies as required. Education: Bachelor's degree in HR, Business, or another related field required; master’s degree preferred. Experience: • A minimum of five (5) years of related experience required, • Experience working in a nonprofit, human services, healthcare, or similarly regulated environment strongly preferred., • Strong knowledge of federal employment laws related to benefits, leaves of absence, and retirement programs, including ACA, FMLA, ADA, EEOC, ERISA, and HIPAA., • Thorough understanding of applicable New York State employment laws and regulations., • Working knowledge of New York City employment laws and local regulatory requirements., • Excellent interpersonal, verbal and written communication skills, including the ability to regularly engage and build effective working relationships with leadership, staff and external stakeholders at varying levels., • Ability to problem-solve and address conflicts and concerns as they arise., • Effective decision-making and time management skills., • Experience with HR software and systems (HRIS). This job is performed in person in a standard office environment with some travel across the NYC metropolitan area required. Physical Requirements: • Employee is required to sit, walk and stand for prolonged period (at least 8 hours)., • Employee is required to effectively communicate both verbally and in writing., • Employee is required to operate standard office equipment such as computers, phones, photocopiers, fax and filing cabinets.
