Position Title: Paralegal Location: Sacramento, CA, 95827 Duration: 6 Months Responsibilities for this position include, but are not limited to: Distinguishing Characteristics The Paralegal is a class characterized by its paraprofessional status, and may be assigned to the District Attorney, Public Defender, County Counsel, or any other County department which employs licensed attorneys. Incumbents in this class are assigned tasks more technical and complex than those of a Legal Secretary I or II, but below the level of the Civil and Criminal Attorney class series. The class is distinguished from that of Legal Research Assistant in that the Paralegal through special training, experience, or a combination of the two, independently performs a variety of sophisticated tasks, relieving licensed attorneys from time-consuming legal responsibilities which can be appropriately delegated to specially skilled, non-licensed personnel. Whereas the Legal Research Assistant is a recruitment class for the Attorney series and must be enrolled in or be a recent law school graduate. Examples of Duties, Knowledge, and Abilities Duties may include, but are not limited to, the following: • Drafts, prepares, files, and serves complaints, answers, writs, notices, subpoenas, motions, and other legal documents., • Schedules witnesses to testify; calendars court hearings., • Drafts and prepares routine correspondence associated with case files., • Performs simple legal research, including the location of statutes, shepardization of cases and computerized legal research utilization., • Compiles, organizes, and analyzes data from investigative and other reports, depositions, discovery, court documents, correspondence and other sources., • Interviews clients, potential witnesses, and other informational contacts., • Drafts and prepares complaints, contracts, resolutions, ordinances and other legal documents for review and approval by licensed attorneys., • Designs and organizes filing systems., • Prepares case files for trial or hearing including organizing and assimilating documentary exhibits for introduction into evidence, using computer assistance where applicable. EMPLOYMENT STANDARDS Knowledge of: • Governmental process, in particular the judicial branch, court system and administrative process • Civil procedures and Rules of the Court, • Legal terminology, • Principles of correct and accepted grammar, punctuation and spelling, • Read and understand statutes, court decisions, and other legal documents, • Work independently to organize work, set priorities, meet critical deadlines and follow up on assignments, • Identify legal parties in compliance with statutory requirements, • Read with comprehension and understanding, • Communicate effectively, both verbally and in writing, • Reason and analyze situations logically and accurately, • Compose explanatory memoranda and business correspondence, • Learn fundamental legal principles applicable to particular types of lawsuits, • Learn legal principles applicable to particular types of lawsuits, • Identify and apply relevant facts related to legal principles of due process, • Use computerized legal research programs, • Operate various office equipment including computer hardware and software, • Work cooperatively with a variety of groups and individuals Minimum Qualifications In accordance with the California Business and Professions Code, Section 6450 (c), as may be amended from time to time, applicants must meet one of the following requirements: (1) Possess a certificate of completion of a paralegal program approved by the American Bar Association. (2) Possess a certificate of completion of a paralegal program at, or a degree from, a postsecondary institution that requires the successful completion of a minimum of 24 semester, or equivalent, units in law-related courses and that has been accredited by a national or regional accrediting organization or approved by the Bureau for Private Postsecondary and Vocational Education. (3) Possess a baccalaureate degree or an advanced degree in any subject and a minimum of one year of lawrelated experience under the supervision of an attorney who has been an active member of the State Bar of California for at least the preceding three years or who has practiced in the federal courts of this state for at least the preceding three years, and a written declaration from this attorney stating that the person is qualified to perform paralegal tasks. (4) Possess a high school diploma or general equivalency diploma and a minimum of three years of law-related experience under the supervision of an attorney who has been an active member of the State Bar of California for at least the preceding three years or who has practiced in the federal courts of this state for at least the preceding three years, and a written declaration from this attorney stating that the person is qualified to perform paralegal tasks. License Requirement: Some positions may require possession of a valid California Driver's License, Class C or higher, prior to appointment to this class. Failure to maintain a valid license may constitute cause for personnel action in accordance with Civil Service Rule 11.4.
