Primo Brands is currently seeking a Legal Counsel supporting Marketing, eCommerce, Sustainability, Quality Assurance and Intellectual Property to be located in Stamford, CT and report to the Associate General Counsel - Marketing and Consumer Law. Primo Brands makes available to this role a “hybrid” work model with at least 3 days a week in the office. As the Legal, Regulatory and Government Affairs function and the Marketing teams are based in the Company’s dual headquarters, in-office time would be in Stamford, CT. This position will advise on legal aspects of marketing, advertising and promotional activities and help the business teams develop creative and compelling campaigns and products that comply with applicable laws, regulations and industry standards while appropriately managing legal and reputational risk. This position will provide practical legal guidance on advertising campaigns, promotions, consumer protection, digital marketing, and related commercial matters. The ideal candidate also has working knowledge of intellectual property issues involving trademarks, copyrights, branding, and content licensing. This position requires practical judgment, strong business partnerships, and the ability to provide clear, actionable advice in a fast-moving environment. This position will work closely with marketing, creative, content, sales, innovation, product and sustainability teams, as well as external agencies and other business partners. Prior in-house experience is a plus. Responsibilities The Legal Counsel – Marketing, Consumer Law and IP will serve as a key member of the Legal, Regulatory & Government Affairs team, providing advice on a wide range of tactical and operational issues for Marketing, Sales (including field operations), Innovation, and Sustainability business teams. The Legal Counsel responsibilities will cover the following areas, including: • Key responsibility: Evaluating claims substantiation and working with marketing, product, technical, research and innovation teams to confirm that the claims are adequately supported before publication., • Lead the legal review of product performance, comparative, health, environmental, sustainability and other express or implied claims., • Advise on marketing, advertising, promotional and consumer-facing activities across channels, including digital, social media, websites, email, packaging, retail, experiential marketing, and traditional media., • Review and advise on advertising copy, campaign concepts, product claims, packaging, disclosures, disclaimers, promotional materials, and other consumer communications., • Review advertising, marketing, promotional, and social media materials for legal risk and compliance with relevant laws, regulations, and guidance., • Provide proactive and pragmatic legal counsel regarding general corporate and commercial matters relating to advertising, promotions and IP., • Provide guidance on omnichannel marketing (including social and digital media, endorsements, user-generated content), sweepstakes, contests, loyalty programs, in-store promotions, consumer and customer disputes, competitor challenges, and other day-to-day marketing and promotional activities., • Counsel marketing, product, e-commerce, sales, and customer experience teams on consumer-facing initiatives., • Partner with marketing, creative and content teams from concept development through launch, helping teams identify legal sound paths to execute creative ideas., • Support innovation and product teams through product development, including product naming, positioning, packaging, claims, launch strategy and lifecycle management., • Acting as a business partner and trusted advisor, providing direct legal counsel to Marketing, Sales, Innovation, and Sustainability executives and managers to support timely strategic and commercial business decisions., • Addressing and managing the marketing and IP needs of the business including: drafting, negotiating, interpreting and advising clients on marketing and IP-related agreements, such as NDAs, joint development and license agreements, influencer, talent, sponsorship, agency, content licensing, co-marketing, and vendor agreements, and IP provisions in commercial agreements, manufacturing agreements, and supply agreements., • Advise on intellectual property matters arising from marketing and product activities, including trademark, copyright, rights of publicity, licensing, content ownership, brand protection, content clearance and third party rights clearance., • Support trademark portfolio management, including clearance, prosecution, enforcement, and coordination with outside counsel. Monitor legal and regulatory developments affecting marketing and consumer practices. • Develop templates, training materials, and practical guidance for business teams. Assist with consumer complaints, regulatory inquiries, and internal investigations. Collaborate with privacy, compliance, product, and commercial legal teams on cross-functional matters. • Coordinate with external counsel and subject matter specialists where appropriate. Qualifications • BA/BS Degree or equivalent., • JD degree required., • 5+ years of relevant experience at a law firm, government agency or in-house legal department., • Demonstrated claims substantiation experience, including evaluating the evidence supporting express and implied advertising and product claims., • Substantial experience advising on advertising, marketing, and consumer protection matters., • Experience reviewing digital marketing, social media, influencer, promotional, and consumer-facing content., • Strong drafting, negotiation, analytical, and project-management skills., • Working knowledge of trademark, copyright, licensing, and rights-of-publicity issues., • Ability to provide clear, practical advice in a fast-paced business environment., • Sound judgment and the ability to prioritize matters based on legal and business risk., • CT or NY State Bar Membership in good standing (or equivalent, CT in-house counsel designation), • Exceptional understanding of negotiation, compliance, and regulatory laws., • Requires exceptional analytical and problem solving skills., • Must be able to work independently and be self-directed., • Must also be able to work in team environment to reach goals and objectives., • The successful candidate should be flexible and open to change.
