Job DescriptionPersonal Injury Attorney - Pre-Litigation Personal Injury Attorney - Pre-Litigation Position Overview We are seeking an experienced Personal Injury Attorney focused on pre-litigation matters to manage and resolve complex plaintiff claims before filing suit. The ideal candidate will oversee early case assessment, claim development, negotiation, and alternative dispute resolution with the objective of maximizing client recovery while minimizing time to resolution. This role requires strong advocacy for injured clients across workers' compensation and third-party claims, effective negotiation and mediation skills, and close coordination with litigation teams when trial preparation becomes necessary. Key Responsibilities • Conduct thorough pre-litigation case evaluation including investigation, legal research, and damages analysis for personal injury and workers' compensation matters, • Develop and implement case strategies aimed at early resolution through demand packages, settlement negotiations, mediation, and arbitration when appropriate, • Draft and submit settlement demands, releases, and pre-suit correspondence; prepare reservation of rights and lien resolutions, • Take and defend depositions as needed in the pre-litigation phase and coordinate evidentiary preservation (medical records, expert retention), • Manage a high-volume caseload while maintaining regular client communication, counseling clients on realistic outcomes and litigation risks, • Collaborate with trial attorneys and support staff to transition matters to litigation when settlement is not achievable; assist with trial preparation tasks such as evidence organization and witness preparation, • Negotiate with insurance adjusters, defense counsel, and third-party representatives to resolve complex claims efficiently and favorably, • Represent clients in mediation, arbitration, and other ADR forums; prepare mediation statements and lead settlement discussions, • Ensure compliance with ethical obligations, case deadlines, and jurisdictional pre-suit requirements; maintain accurate case files and documentationQualifications, • Juris Doctor (JD) from an accredited law school and active state bar admission in good standing, • 3+ years of experience practicing plaintiff-side personal injury law with a focus on pre-litigation or workers' compensation claims; experience handling complex claims preferred, • Proven negotiation and advocacy skills with a track record of successfully resolving matters prior to filing suit, • Demonstrated experience with mediation, arbitration, depositions, trial preparation, and coordinating with litigation teams, • Strong legal research, drafting, and case management skills, including preparation of demand letters, settlement releases, and pre-suit filings, • Excellent client communication skills with the ability to counsel clients through early case stages and settlement strategy, • Ability to manage a diverse caseload, prioritize tasks, and meet deadlines in a fast-paced environment, • Comfort working collaboratively in a team-oriented firm and maintaining professional relationships with opposing counsel and insurance adjusters Medical Dental Vision 401K • For this position, you must be currently authorized to work in the United States without the need for sponsorship for a non-immigrant visa.
