Kahane & Associates, P.A. is a full-service law firm that strictly represents secured and unsecured creditors throughout Florida and Georgia. The Firm provides the full range of services essential to the mortgage banking industry, from foreclosure and bankruptcy representation to litigation, evictions, collections, loss mitigation, and REO closings. Kahane & Associates is conducting a search for an experience Title Examiner for our Sunrise Office. Title Examiner reviews and analyzes title reports, land records, and other relevant documentation to identify all parties with an interest in real property and determine the necessary defendants for judicial foreclosure actions. This role is responsible for examining ownership history, liens, encumbrances, judgments, easements, and other recorded interests to ensure foreclosure proceedings include all necessary parties and comply with applicable legal requirements. This position plays a critical role in supporting foreclosure litigation by ensuring accurate party identification, evaluating title conditions, identifying defects and encumbrances, and providing comprehensive title analysis. Essential Duties and Responsibilities: • Examine and notate comprehensive title searches prepared by third party vendors for judicial foreclosure purposes., • Prepare detailed title reports identifying ownership interests, encumbrances, necessary defendants, title defects, and recommended actions needed to clear title., • Research and examine public records including, but not limited to, deeds, mortgages, assignments, modifications, releases, judgments, liens, easements, plats, restrictions, tax records, probate and guardianship matters, dissolution matters, mobile home reports and other encumbrances., • Identify all parties that may have an interest in the property, including but not limited to owners, heirs, lienholders, judgment creditors, tenants, homeowners' associations, governmental entities, municipal lienholders, and other interested parties., • Review and analyze chains of title to verify ownership history, confirm valid transfers of title, and identify breaks, defects, irregularities, or other matters affecting ownership., • Confirm the accuracy of legal descriptions through review of plats, surveys, subdivision maps, tax records, mobile home reports and other official documents., • Verify the status of delinquent real estate taxes, special assessments, municipal charges, and other governmental liens affecting the property., • Identify title defects and determine whether a title claim is warranted., • Assist in resolving title defects that may impact foreclosure litigation or marketable title., • Preparation of documents for curative purposes (e.g., affidavits, releases, etc.)., • Maintain detailed organized records of all searches, documents reviewed, and communications related to each title examination., • Communicate with clients and update client systems in accordance with client requirements., • Communicate with attorneys, paralegals, lenders, surveyors, county officials and vendors to clarify discrepancies and resolve title defects., • Escalate complex title defects, curative issues, or litigation risks to management or legal counsel with recommendations for resolution., • Maintain confidentiality of borrower, client, and property information in accordance with company policies and applicable regulations. Qualifications • Minimum of 2–5 years of experience in title examination for judicial foreclosure purposes, title insurance, foreclosure, real estate law, mortgage servicing, or a related field preferred., • Excellent written and verbal communication skills., • Strong analytical, organizational, and problem-solving skills., • Working knowledge of real property records, title examination practices, and judicial foreclosure procedures., • Ability to resolve ambiguities through additional investigation., • Ability to prioritize multiple assignments and meet deadlines., • Ability to work independently while collaborating effectively with attorneys, clients, and internal teams., • Ability to proactively monitor and follow up on outstanding title issues, curative matters, supplemental searches, tax information, probate records, and other pending items to ensure timely resolution., • Experience with client systems including, but not limited to, ICE Loansphere (f/k/a LPS/BKFS), Tempo, Quandis ADR, DARA, and Noteflow., • Experience with TLO, Pacer, Provest, Resware and Mobile Home Title Services., • Experience with government backed loans (FHA, VA, FNMA, GNMA, USDA, Freddie Mac).
