About the Role This is a hands-on role focused on removal defense and complex immigration matters, including asylum, waivers, and federal litigation support. Attorneys are directly involved in drafting, case strategy, and courtroom advocacy. Responsibilities • Manage a high-volume caseload focused on removal defense, including asylum, withholding of removal, Convention Against Torture (CAT), cancellation of removal, and waivers, • Represent respondents before the Immigration Court (EOIR), including appearances at master calendar and individual (merits) hearings, • Prepare cases for merits hearings, including case strategy, evidentiary development, and direct and cross-examinations, • Represent clients in custody proceedings, including bond hearings before the Immigration Court, • Prepare and file bond motions and other custody-related filings before EOIR and DHS, • Draft and file motions, including motions to reopen, reconsider, change venue, and terminate proceedings, • Prepare detailed pre-hearing statements, legal briefs, and memoranda in support of applications for relief, including responses to pretermission motions, • Conduct legal research on complex immigration issues, including evolving case law and regulatory developments, • Prepare and draft substantive filings, including asylum applications (Form I-589), waivers (Forms I-601A, I-601, and I-212), and supporting legal briefs, • Handle affirmative and humanitarian applications, including VAWA, U visas, and T visas, with direct involvement in case preparation and documentation, • Compile and organize evidentiary submissions, including country conditions reports, expert declarations, and corroborating affidavits, • Prepare clients and witnesses for testimony, including direct examination and cross-examination strategy, • Appear before DHS/ICE for OSUP/ORR and CART check-ins as needed, • Collaborate with senior attorneys on case strategy and complex legal arguments, • Coordinate with paralegals to ensure timely and accurate filings with EOIR and USCIS, • Monitor court deadlines and maintain compliance with EOIR filing requirements and procedural rules, • Assist with appellate matters before the Board of Immigration Appeals (BIA), including drafting notices of appeal and supporting briefs, • Assist with federal court matters, including habeas corpus petitions and related filings Qualifications • Juris Doctor (JD) from an accredited law school, • Active bar admission in good standing in at least one U.S. jurisdiction required, • Fluency in Spanish and English required, • Strong legal writing, research, and advocacy skills, • Ability to manage a high-volume caseload and meet deadlines, • 4–7 years of immigration law experience preferred, particularly in removal defense, waivers, asylum, and related litigation, • Experience appearing before the Immigration Court and handling merits hearings preferred, • Ability to commute to West New York, NJ required, • This is a full-time, in-person position Compensation & Benefits Salary Range: $130,000 – $145,000, commensurate with experience.
