ESSENTIAL JOB FUNCTIONS AND DUTIES • Collaborates with Participant Benefits/Payroll Audit/TPA regarding delinquencies, reviews and analyzes monthly delinquency report and identifies delinquencies, • Collects delinquent audit and billing amounts, • Obtains employer compliance with payroll audits and obtain necessary documentation, • Researches and resolves audit disputes, • Analyzes delinquencies to be settled, and conducts any necessary research regarding existing delinquencies, including review of payroll audits, • Calculates delinquency and/or settlement figures, • Develops acceptable settlement criteria, • Negotiates optimal settlement for the Fund, • Drafts settlement agreements, • Drafts settlement recommendations to Sr. Legal Counsel, • Follows-up on payment plans and unresolved settlements, • Closing of approved settlements and collection of proceeds, • Assists Sr. Legal Counsel as requested, • Prepares matters for referral to Outside Counsel and conducts necessary research, • Collaborates with Outside Counsel to assure steady progress of cases to be settled, schedules and attends conference calls regarding status of all cases referred to Outside Counsel, • Provides litigation support, including fact finding, preparation and/or review of affidavits, responses to interrogatories and other legal correspondence, review of settlement agreements, • Develops strategy and assists in resolving various projects of collection issues, • Conducts initial review of collective bargaining agreements for minimum standards compliance, • Prepares and transmits fully executed collective bargaining agreements to trustees and outside counsel for secondary review and approval, • Prepares Quarterly Trustee Report and other reports, • Prepares first drafts of addendums, correspondences, reports, and other documents, • Analyzes contract issues to be resolved, and conducts any necessary research regarding contract negotiation, past practices, plan requirements, and compliance and risk management related research, • Ensures that all new and revised executed agreements are accurately updated in the contract database system, • Develops effective working relationships with peer paralegals and other colleagues of the Legal function throughout the Fund, • Monitors Legal email inbox and promptly acts on time-sensitive matters, including scheduling meetings to ensure progress, • Assists with compiling reports relating to the Legal Department for Trustee Workgroup and other meetings, • Primary contact for collections related legal inquiries, • Ensures electronic and hard copy document management files are kept up to date (including filing of emails and correspondence) when active and once closed that they are archived, • Identifies and retrieves information necessary to support legal decision-making, • Sets goals and achieve measurable results, • Contributes ideas to plans and achieving department goals, • Exemplifies the Fund’s BETTER Values and professional effectiveness dimensions in contributing to a respectful, trusting, and engaged culture of diversity and inclusion, • Performs other duties as assigned within the scope of responsibilities and requirements of the job, • Performs Essential Job Functions and Duties with or without reasonable accommodation ESSENTIAL QUALIFICATIONS Years of Experience and Knowledge • 4 ~ 6 years of related litigation or collections experience minimum, • Working knowledge and experience in accounting, collections or auditing preferred, • Working knowledge and experience resolving delinquencies and audit disputes across the demand, dispute, arbitration, mediation, and litigation phases, with primary emphasis on the demand and dispute stages preferred, • Working knowledge and experience with multiemployer / ERISA group health plans, • Working knowledge and experience with Health Insurance Portability and Accountability Act (HIPAA) Education, Licenses, and Certifications • Associate degree in the legal field or related field or equivalent work experience required, • Preferred: Certification in Paralegal studies Skills and Abilities • Intermediate level Microsoft Office skills (PowerPoint, Word, Outlook, OneNote), • Intermediate level Microsoft Excel skills, • Excellent communication skills (written and verbal), • Strong Analytical, math and organizational skills, • Detail oriented with the ability to manage multiple priorities, • Ability to coordinate communications between the Legal Department and other departments, • Ability to effectively interact with all levels of employees and management
