The Litigation Attorney is the most experienced attorney in the Litigation Department — managing the most complex litigated cases, mentoring the department's attorneys, and serving as the senior case strategy and trial-readiness resource before cases transfer to the Trial Department. Role Summary The Litigation Attorney manages a personal caseload of the department's most complex and high-value litigated personal injury matters while providing mentorship, case oversight, and strategic guidance across the Litigation Department. This role handles the cases with the most contested liability, the most aggressive defense strategies, the most complicated discovery, and the highest stakes — requiring deep experience in motions practice, depositions, mediation, and case development through trial readiness. The Litigation Attorney does not carry formal HR authority over other attorneys but functions as a senior peer leader — mentoring Litigation Attorneys, serving as an escalation resource on complex procedural and strategic matters, and helping firm leadership maintain quality and trial-readiness standards across the department. When cases are transferred to the Trial Department, the Litigation Attorney ensures the case file is fully developed and the Trial Attorney inherits a case that is genuinely trial-ready. Core Responsibilities Complex & High-Value Caseload Management • Manage a personal caseload of the department's most complex and high-value litigated matters — including catastrophic injury, disputed liability, multiple defendants, insurance bad faith, complex coverage disputes, extensive expert needs, and cases with significant trial exposure., • Develop sophisticated litigation strategies incorporating case theory, expert witness planning, deposition strategy, evidence development, and damage presentation., • Take and defend depositions of high-value witnesses, including medical experts, corporate representatives, and adverse parties in contested cases., • Draft and argue complex motions — including dispositive motions, Daubert/expert challenges, and contested discovery matters., • Lead mediation strategy and advocacy on complex cases, ensuring Med Charts are verified, case presentations are compelling, and settlement evaluations are realistic., • Evaluate cases approaching trial readiness and determine optimal timing for transfer to the Trial Department or continued litigation management. All Litigation Attorney Responsibilities • Perform all responsibilities outlined in the Litigation Attorney job description, including case receipt from the Hybrid Department, full discovery management, depositions, CME coordination, mediation, Med Chart oversight, PFS management, client communication, treatment monitoring, and team direction — applied to a caseload that skews toward higher complexity and value., • Complete the 15-day structured case review and 125-day case strategy memo for all assigned cases., • Direct the day-to-day work of the assigned Litigation Paralegal and Litigation Legal Assistant., • Maintain the firm's client communication standards and model accessibility and responsiveness., • Ensure no client on the Senior Attorney's caseload experiences a treatment gap exceeding 30 days. Mentorship & Attorney Development • Serve as a mentor for Litigation Attorneys — providing guidance on complex case strategy, contested discovery, deposition technique, mediation preparation, and motions practice., • Support the Hybrid Associate Attorney development pathway by providing litigation-focused mentorship when Associates are preparing to advance., • Conduct case reviews with junior attorneys to evaluate case development, identify gaps in trial readiness, and sharpen litigation skills., • Model the standard for litigation quality, deadline management, and professional conduct in the Litigation Department., • Provide feedback on attorney work product — motions, deposition performance, mediation strategy — and help attorneys develop toward trial readiness. Departmental Leadership & Quality Standards • Serve as a trusted advisor to the Senior Partner and firm leadership on Litigation Department operations, case quality, and trial readiness., • Contribute to the development and refinement of litigation standards, discovery best practices, deposition protocols, and mediation preparation benchmarks., • Participate in departmental meetings to discuss case quality, pipeline health, staffing, and strategic initiatives., • Review borderline or escalated case strategy decisions — including whether to continue litigating, accept or reject settlement offers, or prepare for trial., • Collaborate with the Trial Department to ensure a smooth transfer process and that transferred cases meet trial-readiness standards., • Collaborate with the Hybrid Department to provide feedback on case quality at the point of transfer into Litigation., • Identify systemic litigation quality issues (recurring discovery deficiencies, deposition preparation gaps, Med Chart problems) and recommend improvements. Case Escalation & Second Opinion • Serve as an escalation resource for Litigation Attorneys facing complex procedural situations, aggressive defense tactics, contested expert issues, or difficult settlement evaluations., • Provide second opinions on case value, trial exposure, mediation strategy, and PFS decisions., • Advise on insurance bad faith scenarios, coverage disputes, and Fabre defendant strategies., • Apply experienced judgment to evidence development — identifying the expert witnesses, demonstratives, and evidence preservation strategies needed to maximize case value and trial readiness., • Oversee expert witness retention and preparation for complex cases, including life care planners, vocational rehabilitation experts, economists, accident reconstructionists, and medical billing experts., • Evaluate defense expert strategies and determine the appropriate response — including Daubert challenges, defense expert depositions, and rebuttal evidence., • Ensure non-economic damages proof (before-and-after witnesses, impact statements, lifestyle evidence) is fully developed on high-value cases. Technology & Systems • Filevine — case management, deadline chains, calendar, Med Charts, document management, activity notes, Vitals., • Universal Court Reporting — depositions, CME scheduling, physician video depositions., • Florida Court e-Filing Portal — motions, pleadings, notices., • LexisNexis / Westlaw — legal research, case law, jury instructions., • Court scheduling portals — county-specific hearing scheduling., • Outlook email Required Qualifications • Juris Doctor (J.D.) from an accredited law school., • Active member in good standing with the Florida Bar., • Minimum 8 years of experience handling personal injury litigation matters, including substantial experience with complex discovery, depositions, motions practice, mediation, and court appearances., • Demonstrated success with high-value and complex case resolution., • Strong written advocacy skills — top-quality motions, pleadings, and mediation statements., • Strong oral advocacy skills — experienced in depositions, courtroom arguments, and mediation presentations., • Deep knowledge of Florida civil procedure, personal injury law, and insurance litigation., • Demonstrated ability to mentor and guide junior attorneys., • Excellent client communication skills with a commitment to exceptional client service., • Strong organizational skills with the ability to manage complex cases while fulfilling mentorship and departmental leadership responsibilities. Preferred Qualifications • 10+ years of personal injury litigation experience., • Trial experience or significant trial preparation experience., • Experience with catastrophic injury, insurance bad faith, and complex coverage litigation., • Experience with expert witness retention, preparation, and Daubert challenges., • Experience contributing to departmental standards, training, or quality improvement initiatives., • Familiarity with Filevine or similar legal case management software., • Bilingual (English/Spanish) is beneficial., • Active involvement in professional legal organizations and business development.
